Terms of Service

1. Acceptance

By downloading, installing, or using Sundry ("the app"), you agree to these Terms of Service. If you do not agree, do not use the app. These terms form a binding agreement between you and Samderlust Consulting ("we", "us").

2. Description of Service

Sundry is a back-office tool for solo operators and small businesses. It provides receipt scanning, expense tracking, invoicing, and financial reporting features to help you manage your business records.

3. Eligibility

You must be at least 18 years old to use Sundry. By using the app, you represent that you meet this requirement and that you are using the app for lawful business purposes.

4. User Responsibilities

  • You are solely responsible for the accuracy of business data, receipt information, and invoices you enter into or generate with Sundry.
  • You are responsible for the invoices you send to your clients. Sundry delivers them on your behalf but has no control over their content or terms.
  • You must not use Sundry to issue fraudulent invoices, misrepresent expenses, or evade taxes.
  • You must not attempt to reverse-engineer, hack, or abuse the service.

5. Account Security

You are responsible for keeping your account credentials secure. Notify us immediately at samderlust@gmail.com if you become aware of any unauthorized use of your account.

6. Subscriptions and Billing

Sundry offers a free tier and paid subscription tiers (Solo and Pro). Paid tiers are sold as auto-renewing in-app subscriptions through the Apple App Store or Google Play, depending on where you installed the app.

  • The store bills you, not us. Payment is charged to your Apple or Google account. We never see or store your payment details.
  • Subscriptions renew automatically until you cancel. Your store charges the renewal within 24 hours before the end of the current period unless you cancel at least 24 hours before it ends.
  • Cancel through the store. On iOS or macOS: Settings → your name → Subscriptions. On Android: Google Play → Subscriptions. Cancelling stops future renewals; access continues until the end of the period you already paid for.
  • Refunds are handled by the store. Apple and Google set their own refund policies and decisions. We cannot issue, reverse, or override a store charge.
  • Prices may change. We will give notice through the app or by email before any price change takes effect. Your store will also ask you to confirm a price increase before it applies.
  • Where a free trial or introductory price is offered, its length and terms are shown at purchase. Unless you cancel before the trial ends, it converts to a paid subscription at the standard price.

7. Account Deletion and Account Merging

Deleting your Sundry account does not cancel your subscription and does not stop billing. Your subscription is a contract between you and Apple or Google, and we have no ability to end it on your behalf. Apple in particular does not permit developers to cancel a customer's subscription under any circumstances.

If you delete your account while a subscription is active, you will continue to be charged until you cancel it yourself in the App Store or Google Play, using the steps in section 6. Please cancel first, then delete.

To request deletion of your account and its data, email samderlust@gmail.com. Deletion is permanent: your businesses, clients, invoices, receipts, and uploaded files are removed and cannot be recovered by us or by you.

Merging duplicate accounts. If you sign in with more than one method (for example Apple and Google) and end up with two separate Sundry accounts, the app can attach a sign-in method to an existing account. Where that method already belongs to a second account, you may choose to keep one account and delete the other. The deleted account and everything in it is destroyed permanently, data is not transferred between the two, and the billing rules above apply in full to whichever account is deleted.

If the deleted account held the subscription, you may be able to restore that purchase onto the account you kept — but only from a device signed in to the same App Store or Google Play account that bought it. A purchase made on one platform's store cannot be restored from the other.

8. Intellectual Property

All data you enter into Sundry remains yours. We claim no ownership over your business data, receipts, or invoices.

The Sundry app, its code, design, and branding are owned by Samderlust Consulting. You may not copy, distribute, or create derivative works from the app without our express written permission.

Licence to use the app: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use Sundry on devices you own or control, for your own personal or business use. This licence does not transfer ownership of the app to you.

You agree not to: (a) reverse engineer, decompile, or disassemble the app, except to the extent this restriction is prohibited by law; (b) rent, lease, lend, sell, sublicense, or otherwise distribute the app; (c) remove or alter any proprietary notices; or (d) use the app in violation of any applicable law. We may suspend or terminate this licence if you breach these Terms.

App stores: If you download Sundry from the Apple App Store or Google Play, your use is also subject to that store's terms. Where you obtain the app from the Apple App Store, this agreement is between you and Samderlust Consulting only, not Apple; Apple is not responsible for the app or its support, and Apple and its subsidiaries are third-party beneficiaries of this agreement entitled to enforce it against you.

9. Disclaimers

Sundry is provided "as is" without warranties of any kind, express or implied. Specifically:

  • Sundry is not a substitute for professional accounting, tax, or legal advice. Consult a qualified professional for your jurisdiction's requirements.
  • AI-parsed receipt data (merchant, amount, date) may contain errors. Always verify before submitting to clients or tax authorities.
  • We do not guarantee uninterrupted or error-free operation of the service.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Samderlust Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Sundry.

Our total liability to you for any claim shall not exceed the total subscription fees attributable to your use of Sundry in the twelve months preceding the claim. If you use Sundry on the free tier, that limit is $0.

11. Governing Law

These terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of British Columbia.

12. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via the app. Continued use of Sundry after changes are posted constitutes acceptance of the updated terms.
